ZUSAMMENFASSUNG
Das ärztliche Berufsgeheimnis zeigt Auflösungstendenzen. Einzelne große Katastrophen
lassen den Ruf zur Systemänderung ertönen: Ärzte sollen vermehrt ihr Wissen über Patienten
zur Gefahrverhinderung teilen. Diese ethisch begründete Forderung allein gibt dem
Arzt keine Rechtfertigung zur „großzügigen Handhabe“ der Durchbrechung seines Arztgeheimnisses.
Daher sollte bei einer staatsanwaltschaftlichen Praxisdurchsuchung der Behandler nur
den Weg zur gesuchten Akte zeigen, diese jedoch beschlagnahmen lassen. Einzig ein
strenger Umgang mit dem Arztgeheimnis bewahrt das unabdingbare Vertrauen gegenüber
dem Arzt. Andernfalls pervertiert dieses zukünftig in ein Denunzianten-Arzt-Bild.
Welches Vorgehen bei Krankheit einem Piloten zu empfehlen ist (z. B. arbeits- oder
versicherungsrechtliches Vorgehen, Stichwort: Krankentagegeld-Versicherung), lässt
sich in der Kürze nicht darstellen. Aber auch hier gilt: Keine Kommunikation mit dem
Rechtsanwalt des Piloten ohne Entbindung von der Schweigepflicht.
ABSTRACT
The medical duty of discretion shows resolution trends. Single great disasters let
the call sound for the system change. Doctors should divide increasingly her knowledge
about patient for the danger prevention. Only this ethically reasonable demand gives
no justification to the „generous grounds“ of the breaking of his doctor’s secret
to the doctor. If the public prosecutor’s office searches a medical practise because
of sick person’s documents, the doctor should show only the way to the patient’s act.
The medical record should be confiscated. Only a strict handling with the doctor’s
secret preserves the indispensable trust towards the doctor. Otherwise the doctor´s
reputation perverts in future in an informer’s doctor’s picture. The place is not
sufficient to show juridical recommendations (e. g., labour legislationor insurance
right) for patients who practice the profession pilot (headword: ill day money). For
the doctor also is valid here: He does not communicate with the lawyer about the pilot,
as long as he was not released from his professional discretion.
