Zusammenfassung

Die ärztliche Assistenz zur Selbsttötung (ÄAS) ist Gegenstand der aktuellen wissenschaftlichen und politischen Debatte. Gesetzliche Regelungen in den Niederlanden und dem US-Bundesstaat Oregon sowie die Überarbeitung von Stellungnahmen der Ärzteschaft in Großbritannien und der Schweiz zeugen von einem Wandel der rechtlichen und moralischen Bewertung der ÄAS. Die Assistenz zur Selbsttötung ist in Deutschland nicht mit Strafe belegt. Die Assistenz eines Arztes bei der Selbsttötung eines Patienten kann allerdings zu juristischen Abgrenzungsproblemen hinsichtlich des Straftatbestandes der unterlassenen Hilfeleistung und des Verstoßes gegen die ärztliche Garantenpflicht führen. In der philosophisch-ethischen Debatte ist das Selbstbestimmungsrecht des Patienten Grundlage für den Respekt vor dem selbstbestimmten Willen, sich zu töten. Zur normativen Rechtfertigung der ärztlichen Assistenz bei der Selbsttötung eines Patienten wird ergänzend zum Respekt vor der Autonomie des Patienten das ethische Prinzip des Wohltuns (Benefizienz) hinzugezogen. Dieser Argumentation folgend wird die Assistenz zur Selbsttötung bei Patienten mit besonders schwerwiegendem und nicht behandelbarem Leid als möglicher Bestandteil der ärztlichen Tätigkeit gefasst. Gegner der ÄAS verweisen auf praktische Schwierigkeiten bei der Überprüfung der Selbstbestimmungsfähigkeit des Patienten und der Authenzität des Wunsches. Weiterhin würde eine juristische und gesellschaftliche Tolerierung der ÄAS in der Praxis zwangsläufig zur Tötung auf Verlangen oder gar Tötung ohne Verlangen führen. Empirische Studien zeigen, dass in Ländern, in denen die ÄAS rechtlich erlaubt ist, eine vergleichsweise geringe Anzahl von Patienten an den Folgen der ärztlich assistierten Selbsttötung stirbt. Die Kenntnis rechtlicher Rahmenbedingungen, philosophisch-ethischer Argumente und Ergebnisse empirischer Untersuchungen sind Voraussetzung für eine informierte und wissenschaftlich fundierte Diskussion über ÄAS.

Summary

Physician assisted suicide (PAS) is a matter of the current scientific and political debate. Legal regulations in the Netherlands and the US state Oregon as well as recent changes of statements of associations representing physicians in Britain and Switzerland indicate alterations of the judicial and moral appraisal regarding PAS. In Germany assisted suicide is not prosecuted by law. However, the assistance of a physician with the suicide of a patient may cause problems with respect to distinguishing the matter from a possible offence of the guarantor duty of physicians or the legal duty of third parties to save life and health of a person with respective needs. In the philosophical-ethical debate the right to self-determination is the normative foundation for the respect of the self-determined will to die. The assistance of physicians in the case of suicide of a patient is justified by the conjunction of the principles of autonomy and beneficience. Following this argumentation PAS is seen as a possible part of physicians’ tasks in the case of patients with severe and intractable suffering. Opponents of PAS refer to practical problems with respect to the examination of patients’ mental competence and the authenticity of their wish to die. In addition judicial and societal tolerance of PAS would lead inevitable to voluntary as well as non-voluntary euthanasia (slippery slope). Empirical studies in countries where PAS is a legal option indicate that few patients die as a consequence of PAS. Knowledge about the existing legal framework, the ethical arguments and data of empirical studies are important requirements for an informed and scienfically substantiated discourse on PAS.
